To consider the attached application for a
variation of to the Premises Licence for Il Vino, 28 Queens Road,
Buckhurst Hill, Essex, IG9 5BY under the Licensing Act 2003 Additional documents: Minutes: The three Councillors that presided over this application were Councillors Keska (Chairman), Stocker and Mead. In attendance was the applicant Mr A Long, no objectors were present.
The Sub Committee received a report on the application for a variation to the premises licence for Il Vino. 29 Queens Rd, Buckhurst Hill, IG9 5B, toremove therestriction relatingto theOn Salesof alcoholto pre booked tasting events and allow the sale of alcohol for consumption on and off the premises at any time authorised by the licence (Monday to Sunday 10:00-23:00).
The applicant made their representation and was questioned by the Members of the Sub Committee.
In line with the procedure, the Sub Committee members retired to consider the case, accompanied by the Democratic Services Officer and the Sub Committee’s Legal Advisor. The Sub Committee reconvened in public session to give its decision.
RESOLVED:
The decision of the sub-committee was that the application to vary the premises licence in respect of IL VINO 28 QUEENS ROAD BUCKHURST HILL ESSEX IG9 5BY be granted subject to the following conditions which in the opinion of this Sub Committee are reasonable, proportionate and in the public interest for the promotion of the licensing objectives.
The existing conditions on the licence modified as set out in the application, and the conditions which had been agreed between the applicant and Essex Police Licensing Officer namely:
An individual may not supply alcohol unless that individual has the written consent of the Designated Premises Supervisor or other employed Personal LicenceHolder. A written record of this consent will be retained on the premises at all times when such an individual supplies or proposes to supply alcohol and be madeavailable immediately upon reasonable request of the police or licensing authority. Arefusals record shall be maintained at thepremises that details all refusals tosell alcohol.Each entry shall,as a minimum, record the date and timeof the refusal and the name of the staff member refusing the sale. All entries must be made as soon as possible and in any event within 4 hours of the refusal and the record must be made immediately available to police,trading standards or licensing authority staff upon reasonable request. Theincident logshall eitherbe electronicor maintainedin abound documentwith individuallynumbered pagesand beretained forat least{12} monthsfrom the date of the last entry.
The applicant was reminded of their right of appeal to the Magistrates Court within 21 days of date of the written notification of this decision.
