The three Councillors that presided over this item were Councillors R Morgan, H Mann and P Smith. The Chairman welcomed the participants and requested that they introduce themselves to the Sub-Committee. In attendance on behalf of the application were the applicant Mr A Ciantor and his wife. There were no other people present. The Chairman then introduced the Members and Officers present and outlined the procedure that would be followed for the determination of the application.

 

The Application before the Sub-Committee

 

The legal officer informed the Sub-Committee that the District Council had a received an application from Mr Ciantor for a street trading consent to trade at the layby on A113 London Road, situated between Tracey’s Farm and Murrells Farm (CM5 9QE). The Sub-committee noted that an advert had been put in the local paper and any residents within 150 metre radius, and the proper authorities, had been consulted. No objections had been received.

 

Presentation of the Applicant’s Case

 

Mr Ciantor said that he used to have snack bar in London for 10 years. They had decided to move out of London to access better schools in this area. He wanted to continue cooking for a living and have that social interaction with his customers.

 

Questions for the Applicant from the Sub-Committee

 

Councillor Morgan asked why he had chosen that particular lay-by. Mr Ciantor replied that that it was in the open air, in a nice environment where he could socialise with people. It was a long lay-by on a busy road.

 

Councillor Morgan was worried by the rubbish that might be dropped by their customers, what would Mr Ciantor do to stop this. Mr Ciantor said that they had their own bin and they would take the rubbish home with them.

 

Councillor Morgan asked him if he would have tables and chairs by his van. Mr Ciantor said he would not.

 

Councillor Smith asked the Licensing officer how many occupied properties were within the 150m consultation area. And what was the procedure for the renewal of an application? She was told that there were less than 10 houses in the consultation area and that the renewal of the street trading consent would be treated as a new application.

 

Councillor Mann asked the applicant if there would a sign telling their customers to dispose of their litter in the bin provided. And, would he have signs on display at the beginning of the layby saying that his van was situated in the layby. Mr Ciantor replied that he had two signs one for each end of the layby, one would be situated just before the layby to indicate they were ahead.

 

The legal officer noted that any signs put on the highway would need the permission of the highway authority.
