The Local Government (Access to Information) (Variation) Order 2006, which came into effect on 1 March 2006, requires the Council to consider whether maintaining the exemption listed above outweighs the potential public interest in disclosing the information. Any member who considers that this test should be applied to any currently exempted matter on this agenda should contact the proper officer at least 24 hours prior to the meeting.

 

Confidential Items Commencement: Paragraph 9 of the Council Procedure Rules contained in the Constitution require:

 

(1)        All business of the Council requiring to be transacted in the presence of the press and public to be completed by 10.00 p.m. at the latest.

 

(2)        At the time appointed under (1) above, the Chairman shall permit the completion of debate on any item still under consideration, and at his or her discretion, any other remaining business whereupon the Council shall proceed to exclude the public and press.

 

(3)        Any public business remaining to be dealt with shall be deferred until after the completion of the private part of the meeting, including items submitted for report rather than decision.

 

Background Papers:  Paragraph 8 of the Access to Information Procedure Rules of the Constitution define background papers as being documents relating to the subject matter of the report which in the Proper Officer's opinion:

 

(a)        disclose any facts or matters on which the report or an important part of the report is based; and

 

(b)        have been relied on to a material extent in preparing the report and does not include published works or those which disclose exempt or confidential information (as defined in Rule 10) and in respect of executive reports, the advice of any political advisor.

 

Inspection of background papers may be arranged by contacting the officer responsible for the item.

Minutes:

The Sub-Committee considered an application by Mr S Choudhury for renewal of a current Hackney Carriage Driver’s Licence, due for expiration on 15 July 2014. Councillors M Sartin, H Mann and T Thomas presided over this item. Members noted that officers did not have delegated powers to grant this application and, as a result, the application had to be considered by the Sub-Committee. The Chairman welcomed the applicant and introduced the members and officers present. The Licensing Officer informed the Sub-Committee of the circumstances by which the licence could not be issued under delegated authority.

 

The applicant made a short statement in support of his application, before answering a number of questions from Members of the Sub-Committee. The applicant then made a short closing statement to the Sub-Committee before the Sub-Committee Members retired from the meeting to debate the application in private. The Sub-Committee Members returned to the Committee Room and informed the applicant of the Sub-Committee’s decision.

 

RESOLVED:

 

(1)  That the Hackney Carriage Driver’s Licence for Mr S Choudhury be renewed; and

 

(2)  That the applicant, Mr S Chowdhury, be advised that the licensing authority must be notified if any offences or convictions are incurred.

Driver's Licence - Mr S Manget

(Director of Neighbourhoods) To consier the attached report.

Minutes:

The Sub-Committee considered an application by Mr S Manget to renew a current Hackney Carriage Driver’s Licence, due to expire on 15 July 2014. The Councillors who presided over this item were Councillors M Sartin, T Thomas and H Mann. Members noted that officers did not have delegated powers to grant this application and, as a result, the application had to be considered by the Sub-Committee.

 

The Chairman welcomed the applicant and introduced the members and officers present. The Licensing Officer informed the Sub-Committee of the circumstances by which the licence could not be issued under delegated authority.

 

The applicant made a short statement in support of his application, before answering a number of questions from members of the Sub-Committee. The applicant then made a short closing statement to the Sub-Committee before the Sub-Committee Members retired from the meeting to debate the application in private. The Sub-Committee Members returned to the Committee Room and informed the applicant of the Sub-Committee’s decision.

 

RESOLVED:

 

(1)  That the Hackney Carriage Driver’s Licence for Mr S Manget be renewed; and

 

(2)  That the applicant, Mr S Manget, be advised that the licensing authority’s terms and conditions must always be complied with and that any offences/convictions incurred must immediately be reported to the licensing authority.

Application for a Hackney Carriage Driver's Licence - Mr M Ealaj

Minutes:

The Sub-Committee considered an application by Mr M Ealaj for a Hackney Carriage Driver’s Licence. Councillors M Sartin, T Boyce and H Mann presided over this item. Members noted that officers did not have delegated authority to grant this application and, as a result, the application had to be considered by the Sub-Committee.

 

The Chairman welcomed the applicant and introduced the Members and officers present. The Licensing Officer informed the Sub-Committee of the circumstances by which the licence could not be issued under delegated authority.

 

The applicant made a short statement in support of his application, before answering a number of questions from members of the Sub-Committee. The applicant made a short closing statement to the Sub-Committee before the Sub-Committee Members retired from the meeting to debate the application in private. The Sub-Committee Members returned to the Committee Room and informed the applicant of the Sub-Committee’s decision.

 

RESOLVED:

 

(1)  That the application for a Hackney Carriage Driver’s Licence for Mr M Ealaj be granted for 1 year; and

 

(2)  That the applicant, Mr M Ealaj, be advised that the licensing authority must be notified immediately if any offences/convictions are incurred. The applicant was reminded that the authority did not issue dual plates.

Application for a Private Hire Operators Licence - Ms M Ockenden

Minutes:

The Sub-Committee considered an application by Ms M Ockenden for a Private Hire Operators Licence. The Sub-Committee for this item consisted of councillors M Sartin, H Mann and T Thomas. Members noted that officers did not have delegated powers to grant this application and, as a result, the application had to be considered by the Sub-Committee. The Chairman welcomed the applicant and introduced the members and officers present. The Licensing Officer informed the Sub-Committee of the circumstances by which the licence could not be issued under delegated authority.

 

The applicant was accompanied by her step-father, Mr P Valentine, she made a short statement in support of his application, before answering a number of questions from Members of the Sub-Committee. The applicant then made a short closing statement to the Sub-Committee before the Sub-Committee Members retired from the meeting to debate this application in private. The Sub-Committee Members returned to the Committee Room and informed the applicant of the Sub-Committee decision.

 

RESOLVED:

 

(1)  That the Application for a Private Hire Operator’s Licence for Ms M Ockenden be granted for 1 year; and

 

(2)  That the applicant be advised that any change in the administration of the business be notified to the licensing authority immediately.

The Sub-Committee considered an application by Ms M Ockenden for a Private Hire Driver’s Licence. Councillors M Sartin, H Mann and T Thomas presided over this item. Members noted that officers did not have delegated powers to grant this application and, as a result, the application had to be considered by the Sub-Committee. The Chairman welcomed the applicant and introduced the Members and officers present. The Licensing Officer informed the Sub-Committee of the circumstances by which the licence could not be issued under delegated authority.
